CBDT Notification 121/2026: New TDS Rules on Immovable Property Transfers by Non‑Residents

 Central Board of Direct Taxes (CBDT) ने 22 सितम्बर 2026 को Notification No. 121/2026 (G.S.R. 830(E)) जारी किया है। इसके तहत Income‑tax Rules, 2026 में महत्वपूर्ण बदलाव किए गए हैं। ये बदलाव 1 अक्टूबर 2026 से लागू होंगे।

CBDT ने Income‑tax (Fifth Amendment) Rules, 2026 जारी किए हैं। अब Resident Individual/HUF को Non‑Resident Seller से Immovable Property खरीदते समय Section 393(2) के तहत TDS काटना और Form 141 में Schedule E रिपोर्ट करना अनिवार्य होगा। जानिए पूरी जानकारी।

⚖️ Key Change – Section 393(2)

अब यदि कोई Resident Individual या Hindu Undivided Family (HUF) किसी Non‑Resident Seller से Immovable Property (Land/Building) खरीदता है, तो उस पर TDS Deduction अनिवार्य होगी।

  • पहले केवल Resident Seller के मामलों में Schedule B लागू होता था।
  • अब Form 141 में नया Schedule E जोड़ा गया है, जो Non‑Resident Seller के Transactions को कवर करेगा।

📋 Details Required in Form 141 – Schedule E

Resident Buyer को निम्नलिखित जानकारी रिपोर्ट करनी होगी:

  • Property Details – Address, Type (Land/Building/Both)
  • Buyer Details – PAN, Name, % Share of Consideration (Total 100%)
  • Non‑Resident Seller Details – PAN (if available), Name, Status Code, Contact No., Email, Overseas Address, TRC Number, TIN/Unique Foreign ID, % Share (Total 100%)
  • Agreement & Registration Dates
  • Stamp Duty Value (SDV) & Total Consideration
  • Payment Mode – Lump‑sum / Installments (with previous acknowledgement for subsequent installments)
  • Seller‑wise Details – Section 202(1) option, LTCG/STCG character, earlier payments, current payment, date of credit, amount liable to TDS, applicable rate, Section 395 certificate details, tax deducted (including surcharge & cess)

⚠️ Compliance Action Points

  1. From 01.10.2026 – Non‑Resident Seller transactions को Schedule B में रिपोर्ट न करें।
  2. TDS Rate – Flat 1% नहीं है। Deduct tax at rates in force या Section 395 certificate के अनुसार।
  3. Mandatory Non‑Resident Details – Overseas address, email, contact number देना अनिवार्य है, चाहे PAN उपलब्ध हो।
  4. PAN Not Available – TRC और TIN/Foreign ID देना आवश्यक है, अन्यथा Rule 217 के तहत Higher TDS लागू होगा।
  5. Before First Payment – TRC, TIN/Foreign ID, Overseas Address और Section 395 certificate collect करें।


यह संशोधन भारत में Cross‑border Property Transactions को Tax Net में लाने का एक बड़ा कदम है। अब Resident Buyers को Non‑Resident Sellers से Property खरीदते समय TDS Deduction और Reporting की पूरी जिम्मेदारी निभानी होगी।
