             बीमारी के कारण छुट्टी ली, लौटते ही नौकरी से निकाल दिया! क्या प्रोबेशनर कर्मचारी को ऐसे हटाया जा सकता है?

संदीप मिश्रा नाम का एक युवक था, जिसने एक कंपनी में प्रशिक्षु (ट्रेनी) इलेक्ट्रिशियन के पद पर काम शुरू किया। उसकी नियुक्ति के समय उसे बताया गया कि छह महीने तक वह परिवीक्षाधीन (प्रोबेशन) रहेगा। संदीप मेहनती था और काम सीखने के लिए उत्साहित भी।

लेकिन कुछ ही महीनों बाद अचानक वह बीमार पड़ गया। बीमारी इतनी गंभीर थी कि उसे इलाज के लिए लंबी छुट्टी लेनी पड़ी। डॉक्टरों की सलाह पर उसने अपनी छुट्टी बढ़ाई और जब वह स्वस्थ होकर वापस लौटा, तो उम्मीद थी कि उसे फिर से काम करने दिया जाएगा।

यह मामला धीरे-धीरे श्रम विवाद (Industrial Dispute) बन गया और अदालत तक पहुँचा। छत्तीसगढ़ उच्च न्यायालय ने इस पर विचार किया। अदालत ने कहा कि किसी प्रोबेशनर को नौकरी से निकालने की शक्ति नियोक्ता के पास होती है, लेकिन यह शक्ति असीमित नहीं है। यदि बर्खास्तगी का कारण केवल अनुपस्थिति या छोटा कदाचार है, तो इतनी कठोर सजा देना "अनुपातहीन" (Disproportionate) है।

न्यायालय ने यह भी माना कि इतने लंबे समय बाद संदीप को फिर से उसी नौकरी पर बहाल करना व्यावहारिक नहीं होगा। नियोक्ता और कर्मचारी के बीच विश्वास टूट चुका था। इसलिए अदालत ने एक संतुलित रास्ता निकाला—संदीप को नौकरी पर वापस रखने के बजाय उचित वित्तीय मुआवज़ा दिया जाए।

            Sandip Mishra joined a reputed industrial company as a trainee electrician. At the time of his appointment, he was clearly informed that he would remain on probation for six months. Sandip was eager to learn and started his work with dedication.

              However, just a few months into the job, Sandip fell seriously ill. On medical advice, he had to take leave and later extend it for proper treatment. Once he recovered and returned to the company, he expected to resume his duties.

            But the company refused to let him work again. He was orally told that his services had been terminated, citing “unauthorized absence.” Sandip was shocked—his absence was due to illness, and he had informed the company about it.

            This dispute eventually escalated into an industrial dispute under the labour laws of Madhya Pradesh and Chhattisgarh, and the matter reached the Chhattisgarh High Court.

लागू कानूनी प्रावधान

इस मामले में कई महत्वपूर्ण श्रम एवं सेवा कानून लागू हुए:

• Industrial Disputes Act, 1947 : यह अधिनियम औद्योगिक विवादों के निपटारे और कर्मचारियों के अधिकारों की रक्षा करता है। संदीप का मामला इसी अधिनियम के तहत औद्योगिक विवाद माना गया।

• Labour Laws of Madhya Pradesh and Chhattisgarh : क्षेत्रीय श्रम कानूनों के अनुसार, प्रोबेशनर को भी न्यायसंगत प्रक्रिया और अनुपातिक सजा का अधिकार है।

• Doctrine of Proportionality : सजा और कदाचार का अनुपात संतुलित होना चाहिए। छोटी गलती पर बड़ी सजा देना कानूनन गलत है।

Court’s View

The High Court observed that while an employer does have the power to terminate a probationer, this power is not unlimited. If the termination is based on minor misconduct or absence due to illness, imposing the extreme penalty of dismissal is disproportionate.

The Court also noted that reinstating Sandip after such a long time was not practical. The relationship between employer and employee had broken down. Forcing reinstatement could disturb the workplace environment.

Therefore, the Court adopted a balanced approach—rather than reinstating Sandip, it directed the company to pay him lump-sum financial compensation.
